Los Angeles, CA—I wrote extensively about legendary record producer, Phil Spector’s first murder trial that ended in a mistrial when jurors could not reach a unanimous verdict. . I was not able to do much with the retrial because of other commitments, but it was even worse that the first trial.
Both trials were as unfair, and as outrageous as I’ve ever seen in my 40 years of experience inside the criminal justice system. During the trials I compared L.A. Superior Court Judge Larry Paul Fidler to Roland Freisler, the President of The People’s Court of Germany’s Third Reich. I don’t think that was an exaggeration because of nearly every ruling made by Fidler.
It was obvious to me that Judge Fidler had an agenda to convict Spector at any cost after numerous embarrassing high profile acquittals of other celebrity defendants. Fidler was drunk with power as he satisfied the harpy-pundits of that failed TV network, Court TV. It just so happened that I met Judge Fidler when he was invited to San Francisco to attend an Investigative Reporter’s and Editor’s conference in San Francisco with that very pretty, former Court TV correspondent, Beth Karas.
Spector’s trial was not about evidence but was an exercise of pure hatred. The trial manifested hatred for Spector’s wealth, flamboyant hair, manner of dress and lifestyle.
Spector had a lifetime’s worth of gold-digging women satisfying his libido and then angered when Spector did not give them the wealth and fame they sought. The very worst of this group were allowed to testify against Spector about decades old affairs.
Spector’s real crime was his sometimes horrible taste and judgment in the women he allowed in his bed. In that mix were thieves, extortionists and drug addicts. Some would return to haunt Spector for a slim chance at fame and of course the cash they could get from the tabloids for their tall tales.
The dead woman, Lana Clarkson fit Spector’s bedmates well. Clarkson was a failed and now too old actress with habit for ingesting Vicodin nearly a dozen times a day. The poor woman was an alcoholic suffering from depression and was nearly destitute. It was clear that Clarkson was under the influence of both drugs and alcohol when she died.
None the less Clarkson was a sympathetic figure that Hollywood used and spit out. Clarkson was beautiful and there was evidence she tried very hard to gain fame and fortune that sadly never materialized. Clarkson was really just another tragic story from The Boulevard of Broken Dreams.
Clarkson did not go home with Phil Spector who she just met for anything more than an act of commerce. Spector had money and Clarkson needed some.
A violent death occurred but the evidence of murder just was not there. On the contrary there was a lot of evidence suggesting suicide or a self-inflicted accidental shooting by a drunken woman.
We don’t have a video, instant replay of this tragedy. We and the jury had to guess how Clarkson died. It’s a human trait to want to assign blame for a needless death. The blame went to Phil Spector.
In Judge Fidler’s court Clarkson’s problems were sanitized while any and everyone who wanted was encouraged by the jurist to throw mud on Spector.
Phil Spector was railroaded to a prison cell for more years than the 70 year-old has left on earth. Spector very well may never live long enough to win his appeal. This is wrong.
With The People’s Court of Germany, the public did not see much of anything wrong with Judge Freisler’s show trials either. “Justice” was always administered there, swift and sure. What happened in this Los Angeles courtroom can happen to you or someone you love.

Phil Spector Was Railroaded In A Legal Outrage
Los Angeles, CA—Judge Larry Paul Fiddler seemed like such a personable fellow when I met him in San Francisco at a function hosted by the Investigative Reporters and Editors some six years ago. First impressions are sometimes misleading.
Fidler had the duty to give murder suspects a fair trial under our sacred system of justice. When legendary record producer Phil Spector’s murder case came before Judge Fidler, fairness was replaced by judicial tyranny.
Fidler consistently ruled for nearly every request by prosecutors while denying nearly everything for Spector’s defense. Fidler was more biased than any judge I’ve seen in some 40 years.
Fidler was out to prove that a celebrity could get convicted after a stunning series of acquittals of other accused Hollywood notables.
Fidler was asked repeatedly to recuse himself and when he refused the defense went as far as the Court of Appeals and lost the argument.
The real abuse of judicial discretion was surrounding the newly revised California’s evidence code 1101B that could allow the introduction of so-called prior bad acts committed by the defendant.
Fidler allowed a string of women jilted by Spector to come into court and accuse Spector of whatever they wanted. Allegations surfaced that were never reported to police and there was never a prosecution or trial to sort out fact from fiction. The tales were decades old and the women telling them were felons, freeloaders and even sold their stories to the tabloids.
As for the evidence or rather a lack of it, the jury was allowed to be tainted by a very public hate campaign often centering on the aging Spector or his appearance.
The case was far more about salacious gossip than facts. The pretty dead woman, Lana Clarkson was painted as saintly or angelic. The truth was that she was a troubled alcohol and drug addicted woman who stole from her friends and lived under a cloud of poverty and depression.
The prosecutors took steps to cover up Clarkson’s real problems by asking the Los Angeles County Medical Examiners to not conduct the normal psychological autopsy done in such cases. This obstruction of justice was criminal to say the least.
The prosecution made a, Motion to Fix and Judge Filer sustained that motion. The jury was swayed by the avalanche of what should have been inadmissible garbage rather than evidence. The result was a miscarriage of justice.
Lana Clarkson died at her own hands while heavily intoxicated.
Now Phil Spector can watch the Clarkson family loot his estate as he rots in a prison cell for a year or few until his case is reviewed by a higher court.

Phil Spector’s Future
Los Angeles, CA—The chances of legendary record producer Phil Spector getting a new trial are really high. The primary reason is Judge Larry Paul Fidler’s prosecution favoring rulings allowing unprecedented use of ancient and uncharged prior bad acts. These interlopers into the Spector inquiry tainted the jury.
Rather than evidence a successful hate campaign brought a conviction that was not supported by the physical evidence.
I see a solid conspiracy to frame Phil Spector because of the efforts made by officials to evade normal objective investigation efforts by police, prosecutors and the Medical Examiner. Lana Clarkson’s mental state was suspected in playing a role in her death. Documented problems included:
1. Alcoholism
2. Drug addiction.
3. Financial problems
4. Despondency based on writings and other communications
5. Intervention by medical professionals for these problems.
The normal procedures are to conduct a psychological autopsy where these kinds of issues are involved with any case where there is any possibility of suicide. They avoided doing this simple procedure for only one reason, to hide the truth.
What can be done now? The pursuit of motions for mistrial, new trial and other yet to be seen avenues is already underway. The first stop must begin with Judge Fidler. Nobody realistically expects Fidler to do the right thing now but the efforts are necessary to preserve appeal rights.
An investigation into jury misconduct is underway. Motions based on these findings can be introduced with motions at any time to the trial court. There is a Wild Card in this mix and that’s the wrongful death lawsuit pending against Phil Spector by Donna Clarkson.
Spector has the right to defend himself in this civil action too. Spector has the power to bring witnesses forth into forced depositions and court testimony. Additional evidence helpful to Spector will surface here and could affect the conviction if strong enough.
The only public officials that could intercede and bring about a reversal right now is the judge, District attorney or the Governor. That’s not going to happen unless something serious surfaces that proves Spector’s innocence.
A notice of appeal will be filed with the trial court and the lengthy process of appeals will begin. No action will be taken by the Court of Appeals until between one and three years. That’s the normal course of business. I expect at the first stage a new trial will be ordered or the court may even find that the damage was so severe that a new trial would in itself be unfair because of prior defective rulings at the trial court level.
The question is will Spector survive incarceration in a California prison during this process? I think the prognosis is very poor for the 69 year-old Spector whose health has already been severely compromised by this entire ordeal.
Justice ultimately may be denied because once a defendant passes away all litigation will end.

Spector Verdict Is An Injustice
Los Angeles, CA—Legendary record producer Phil Spector should have never been arrested. Spector was arrested, tried and put through two trials that were unfair and un-American.
The most outrageous departure from fairness was the introduction of evidence of some failed relationships spanning 30 years. Recently in California lazy prosecutors created a voter proposition that would allow them to bring up uncharged or proven past allegations. I say lazy because this made convicting people including innocents a lot easier.
In Spector’s case the allegations were actually outside that proposition that became law. Most states would never allow that kind of gossip to taint a defendant’s trial.
The accusations against Spector should have stood or fallen on the scientific evidence alone. The jury was heavily influenced by gossip and hate rather than evidence.
The jury in this high-profile case should have been sequestered because of the media interest and thousands of pages of material posted on the internet most of which is inaccurate or worse. Jurors cannot be trusted to discontinue their Internet use while assigned to their duties. A Google search of Phil Spector and murder provided these results: “Results 1 - 50 of about 431,000 for Phil Spector Murder. (0.34 seconds)”
Judge Larry Paul Fidler took the prosecution’s side from the very beginning of the case, ruling for them on nearly every point raised during the pendency of the case.
This kind of injustice rarely gets anyone’s attention until they or a loved one is suddenly on trial.
I’m confident that Phil Spector’s conviction and sentence will be overturned. I’m not so confident that Phil Spector will survive long enough for the legal reviews of these serious issues.
In the mean time we can count on Lana Clarkson’s mother to use this conviction to her advantage in a civil court to loot Phil Spector’s sizable estate.

Breaking News! Phil Spector Verdict Is In!
Los Angeles, CA—The jury deliberating the second murder trial of record producing legend, Phil Spector has returned a verdict.
KNBC planed a live webcast but that effort failed. Here is the latest:
Los Angeles, CA—The six man, six woman jury in the Phil Spector case returned a Guilty verdict on the Second Degree Murder charge and a finding that he used a gun in the commission of a crime.
The prosecution has demanded that Spector be remanded to custody pending appeal. The defense has lots of motions to make now for an appeal bond and for a new trial.
Judge Larry Paul Fidler remanded Spector into custody until May 29, 2009 when he will be sentenced. Spector will be taken off to the L.A. County Jail where he will be held.
There will be more events today and we will have to wait for them to unfold.

Spector Jury on another misconduct opportunity Holiday!
Los Angeles, CA—The jury in the retrial of music legend Phil Spector must need more time to catch up on their Internet surfing of Spector related websites. This time it’s a woman juror who reportedly complained of illness and the jury was sent home.
Reportedly the ill juror will call in the morning and provide an update on her condition. Depending on the report the jury may return to deliberate only for a half day because of Good Friday.
In any event the jury deliberations will continue on Monday. I know they found the Clarkson family hate blogger’s site, now perhaps they can find mine, for another point of view.
Update: As of 8:35 AM Friday, the ill juror is on the mend and deliberations will resume at least for a half-day.

Spector Case Suicide and blood spray.
Los Angeles, CA—Nobody could recreate the shooting death of Lana Clarkson under controlled and observed conditions without using a living victim. We don’t really know for sure about blood spray. The jury has to take the guess of experts all of which never once witnessed such a shooting.
Then there are those who spread a myth that woman would never put a gun in their mouth to commit suicide. Now there exists a gun range video of a woman, Marie Moore, 44 who first murdered her son and put the gun in her mouth and killed herself Lana Clarkson style.
It’s too bad the video can’t be reviewed by the Spector jury so they can see firsthand that these things happen and the behavior of the human mouth during the explosion. The spray from that woman’s mouth must have been quite a sight.

Phil Spector Jury Back to Deliberations
Los Angeles, CA—The jury returned to a few lame questions from Judge Fidler about media exposure this morning. Fidler sent the jury back into deliberations and now (12:20 PM)they are on their lunch break.
The media has far more interest in the Rihanna/Chris bitch-slapping case than the four year-old murder inquiry involving the death of Lana Clarkson by her own hand.
It’s a sad day when misdemeanor possible plea agreement overshadows a case where a man is on trial for his life.
Update: 4:00 PM--The jury paused long enough to submit a yet to be made public question and went home for the day. The question will be read and addressed in the morning with both prosecution and defense lawyers present.

The Phil Spector Jury Gets More Time To Engage In Misconduct
Los Angeles, CA--The Phil Spector murder trial jury returned to a four-day holiday only to deliberate a half day yesterday and they have been released by Judge Larry Paul Fidler until Monday. One juror claims to be ill and instead of replacing him with an alternate juror they have been sent home.
Will those jurors be able to stay away from the Internet? Will they be able to avoid the loads of published material that has been ruled off limits for the trial? I say there is no chance in Hell that will be the case.
Judge Fidler is doing all he can to taint this jury into convicting Phil Spector. Letting this jury to avoid timely deliberations can only work against Phil Spector and his right to a fair trial.

Lana Clarkson’s Life and Death OnThe Boulevard Of Broken Dreams
Venice, CA—In a tiny cottage here lived Lana Clarkson. She was a great looking glamorous lady. She sought work as an actress/entertainer with limited success. In Hollywood you either have an agent or you are unemployed. Agents are difficult to obtain even for very talented people. Clarkson needed an agent.
Lana Clarkson was not particularly talented but talent is not a requirement to make it in this town if you have the looks. There is no formula, but getting famous before your famous helps a lot. Hollywood was the birthplace of the publicity stunt. The trick is to pull one off without getting arrested. Actress and comedienne, Carol Channing was always a champ of the PR stunts.
Lana Clarkson had one B-movie, starring role and little to brag about or more importantly, pay the rent. I know many like Lana here in L.A. that are emotionally hurting while waiting to fulfill a dream.
Hollywood is unforgiving about age. For women it is doubly true. Clarkson turned 40, a milestone of old age for any actress. For an actress that has not achieved the desired career it is devastating.
Clarkson had another problem that destroyed her hope and that was a horrible fall that fractured both of her wrists crippling her for months in the recent time frame before her tragic death.
Lana became dependent upon pain killers for her emotional pain as well as the physical pain. Alcohol was also a big problem but still Clarkson tried to cope in an untenable situation.
Clarkson was forced to take a minimum wage job serving the people that she hoped were her peers. The earnings for that job were insufficient to pay for her cottage, a car with insurance, her utilities, food and her Vicadin addiction.
Clarkson had the looks and appeal to be a great porn star but sidestepped that temptation. That to me shows she was making a better choice.
Her job as a hostess at the House of Blues put her face to face with aging music legend Phil Spector. Clarkson did not know Phil Spector, but joined him at his home after work. I’m convinced this was an opportunity to supplement her income with a low profile act of prostitution. There’s no question Clarkson needed any money she could get.
I don’t condemn Clarkson for doing what she had to do in order to try and survive. It should have never been a matter for public consumption. Hollywood is full of part-time hookers that later became stars. Many wanted to be stars but wound up as hookers and porn stars instead.
There are other unflattering things that came out about Clarkson. She often raided medicine cabinets of her friends in search of drugs for her addiction. She swindled several friends out of as much as $60,000.00 to finance a vanity film she wanted to use as a demo to showcase her act. The demo tape was an entertainment disaster. I’m sure she expected her stalled career to move and she’d pay back her friends in full. It just did not happen.
Clarkson’s hopes and dreams evaporated. A 40 year old woman with no marketable skills was out of luck and money. That left her even more despondent and hurting. This is incredibly sad but often repeated scenario in Hollywood. If someone could have whispered to Clarkson before she left school, “Lana, don’t quit, stay in school.” Maybe there would have been a much better ending.
While very drunk in Spector’s home Clarkson found a gun. I’m convinced horseplay began and an accident or suicide resulted. There were no witnesses. People are left to guess, speculate or wonder what really happened.
Found by police on a sink, were a pair of false eyelashes. On Phil Spector’s Scrotum Saliva belong to Clarkson was found. On one of Clarkson’s breasts Spector’s Saliva was found. This supports the prostitution angle since she was a stranger to Phil Spector.
Clarkson’s friends and family have been in immense pain. They blame the record producer just because he’s an easy target. The evidence for murder or manslaughter is just not there. Lana Clarkson is not coming back. She’s dead.
I grieve for Clarkson’s mother and sister. They did not deserve their loss. There is nothing for them to do but move on and make the best of their lives. We are all in this together and none of us will be leaving this world alive.
I hope people can still smile about some good times with Lana Clarkson. I’m sure there must be some great memories.

Spector Jury Under Cutting Edge Defense Investigation Scrutiny
Los Angeles, CA—Jurors are on a four day holiday until Wednesday when they return to Judge Larry Paul Fidler’s jury room to determine the fate of legendary record producer, Phil Spector.
What the jury does not know their Internet activities have been closely monitored for violations of the court’s order to avoid conversations along with any form of publication involving Spector and any witnesses.
Cutting edge surveillance devices have already exposed some jury Internet surfing and e-mails. The involved jurors will only have to face the music for this behavior should Spector be convicted.
If there is a conviction on any count the defense will move for a mistrial and present their evidence. A single incident will be sufficient to obtain a mistrial and a third trial would be likely. Should Spector be acquitted or the jury hangs, the defense will not need to reveal whatever they know about jury misconduct.
Any members of the jury exposed for misconduct will have a serious problem with Judge Fidler. Considering the cost of Spector’s trial it will be understandable.

Will Hate Or Real Evidence Decide Phil Spector’s Fate?
Los Angeles, CA—The parade of jilted former girlfriends and disdain for Phil Spector’s wealth and celebrity have all been used to fan the fires of a lynch mob. Prosecutors were on a mission to convict Phil Spector no matter the evidence and have enjoyed judicial free rein throughout two murder trials.
The current jury has been getting too much of their evidence the same way most juries do these days, over the Internet in violation of court rules. At least one blogger is believed to be spewing daily hate and misinformation on behalf of the family of Lana Clarkson who are hoping for a conviction that will enable them to loot Phil Spector’s estate in their pending civil action.
The scientific evidence to murder is simply not there. Since there were no witnesses Judge Larry Paul Fidler has allowed the jury to be swayed by allegations spanning nearly four decades concerning Spector’s prior relationships. Never in Phil Spector’s 69 year history has he ever physically injured anyone.
It was a drunken, destitute and despondent Lana Clarkson who had both of her own hands on the gun that killed her. The only rational explanation for Clarkson’s presence at the Spector home was to engage in an act of unlawful sexual commerce.
Can the jury see past the propaganda to the only reliable evidence and do the right thing? No jury Guilty verdict should be the product of a guess. Having to guess means the defendant is Not Guilty. Will the jury do the right thing? Time will tell.
The prosecution and defense are wrapping up final arguments and with jury instructions pending the case may be in the hands of this jury tomorrow (Wednesday).
One thing for sure, Judge Larry Paul Fidler did absolutely everything he could to deny Phil Spector a fair trial. If convicted Spector would win a new trial but it’s doubtful at least to me that Spector will live long enough to benefit from any appeal of a conviction. This jury is the court of last resort for Phil Spector.

At least one blogger is believed to be spewing daily hate and misinformation on behalf of the family of Lana Clarkson who are hoping for a conviction that will enable them to loot Phil Spector’s estate in their pending civil action.

Will Phil Spector Be His Own Best Witness?
Los Angeles, CA—Record producing legend Phil Spector, is on trial for his life in connection with the death of Lana Clarkson. A huge question for Spector and his lawyers is whether or not to have him testify.
The conventional wisdom says no. However there are circumstances present that change that scenario. First it may open the door for testimony from people that hate him. The hate campaign in the form of a bimbo parade of spurned but otherwise uninjured lovers already tainted the jury and it can’t get any worse now.
Spector will have to withstand cross-examination from prosecutors. I think Spector won’t have any real trouble here. He is the only living witness that knows what happened. He can tell the world what he knows and settle the facts. The only serious problem is that Phil Spector mumbles and will be difficult to hear. He’s also had surgery that further obstructed his voice projection abilities.
To me it’s very conceivable that Clarkson, who had a habit of stealing from her own friend’s medicine cabinets, would have opened the drawer where the gun was found and began some drunken horseplay that ended in her tragic death.
Only Phil Spector can tell the jury what he told that limo driver. That driver did not understand Spector. That will show Spector was personally convinced that the driver had summoned help from paramedics and the police. It’s very understandable why Spector did not make the 911 call himself if he thought his hired help already did that.
That decision is made by the Defense Commander, attorney Doron Weinberg. You can't argue that it’s really up to the defendant because a defendant must obey the wishes of his lawyer. Lawyers generally don’t want their clients to testify.
My guess is that Phil Spector would have everything to gain and nothing to lose by telling us all what happened.
It will be very sad for Phil Spector if he never gets the chance to let the truth set him free. Will the jury break the rules and punish Phil Spector if he does not testify? Stay tuned…

Prosecutors Hope For A Compromise Verdict On Spector Murder Trial.
Los Angeles, CA—Prosecutor’s know they have a paper thin case against music legend, Phil Spector in connection with the death of Lana Clarkson. The facts in the way of a conviction are that the woman was a drug addicted, alcoholic with the weight of the world on her despondent shoulders and the fact that the science of this case exonerates Spector.
The trial has been a non-stop hate campaign and character assassination of the producer by a lifetime's collection former jilted girlfriends. Then there’s the illegal alien limo driver who got a free Green Card for telling the cops what they wanted to hear. He claimed to have heard a “confession quote” from a distraught mumbling Phil Spector.
Prosecutors fought tooth and nail for a lesser charge because they know a lesser conviction is easier to obtain. That’s a disingenuous reason to say the least. Judge Larry Paul Fidler has done all he could do to help prosecutors convict Spector. Now the judge included an uncharged Involuntary Manslaughter count to allow the jury to compromise rather than acquit. A compromise by jury members is wrong. Either Spector is a murderer or he’s not.
Under our system of law it is better that ten guilty men go free than one innocent man be convicted, except in the court of Judge Larry Paul Fidler.
The jury will struggle with a guess as to what they think really happened and arrive at a verdict. A guess is wrong since there must be proof beyond a reasonable doubt. I stand convinced that the filing of charges in this case was a travesty.
If Spector is convicted of either charge he will die in prison. That fate should be based on more than a guess.

Uncovering Jury Misconduct Can Void A Conviction

Our jury system is far from perfect since people called to jury duty seem to have little problem with committing perjury. Far too often the people sitting on juries are having too much fun at the expense of justice.
There are those people who are addicted to trial watching who think the job of a juror is to aid the prosecution in convicting the accused. Some actually believe that the cops have secret evidence that can’t bring into a courtroom for technical reasons that are solid proof of guilt. It’s nearly impossible to uncover this kind of bias before a juror is seated.
The jury pool is always made up of retired people or simple civil servants with jobs that reward them for jury service with civic duty pay. Idle people are very prone to misconduct.
It would be far better to randomly draft jurors who come from the ranks of sought after professionals. They very people who always escape jury duty because their jobs are too demanding like physicians and corporation executives.
The last juror I’d ever want on my panel is the one wanting to be there. Nobody in their right mind should enjoy the inconvenience and role of a juror.
I’ve learned that on at least one jury hearing an attempted murder trial the majority on the panel had Google the defendant’s and so called, victim’s name. The jury continued to seek information outside the court on the Internet for the length of the trial. The defendant was acquitted perhaps because the disobedient jurors learned some information about the alleged victim that was held back from them. You see the star prosecution had an extensive criminal record and was an illegal alien. That information was published right here on my blog,
This story is just too good. A convicted defendant’s mother set out on her own to investigate juror misconduct and exposed a total scumbag with surreptitious tape recordings.
There are many states that allow for, one-party consent to that type of taping. In Michigan and California it’s a serious crime. Perhaps because the politicians in those states are afraid to be caught on tape committing extortion like a certain Illinois Governor was recently.
I’ve been convinced that the first and second jury in the Phil Spector Murder Trial has been surfing the internet trying to find out what gossip they may be missing about the people involved.

Is there a Second Spector Mistrial Brewing?
Los Angeles, CA--I’ve learned that at least one unnamed juror in the Phil Spector Trial allegedly is in a panic about having his personal Internet records subpoenaed and is trying to get off the jury before that happens.
I did an earlier story about concerns over this kind of jury misconduct. Perhaps a juror or two has learned that their private Spector case media surfing is not so private especially when they’ve been ordered by the court not to do that.
Of course to the person who contacted me I’d like to know much more about any similar misconduct in the Spector trial. Please call me or send me e-mails.

The Internet And The Phil Spector Trial
Los Angeles, CA—Celebrity justice is a strange animal. Either the accused is or because of a sensational crime becomes a celebrity. When that happens it’s dangerous to the very core of our American justice system.
Too often I’ve seen celebrities prosecuted simply because some cops and prosecutors know only too well they may hang on to the coattails of celebrities they too will gain fame and fortune.
The issue of fame and fortune too often taints criminal and civil trials. Indictments are sought just to raise the political profile of prosecutors and other government bureaucrats. Often judges change their personal behavior and make rulings designed to prolong their time in the spotlight. No high profile can begin without a press release boasting of an arrest or indictment
In our society the celebrity phenomenon brings bizarre results. Celebrities are created by the press for talent or some innocent or nefarious involvement in a monumental event.
The O.J. Simpson murder trial made numerous careers of lawyers, writers, broadcasters, a dishonest LAPD homicide detective and a freeloading Simpson house guest. Many went from government salaries to serious financial rewards. Simpson’s prosecutors did not fair too well from publicity simply because they lost the case.
Unfortunately infamy makes people rich as quickly as fame for admirable deeds. Disgraced detective Mark Fuhrman was the only person convicted of a crime in the Simpson case. He used his perjury conviction like a sword to become a multi-millionaire as an author and broadcast crime commentator for Fox News. He also is a talk show host. Today most people have forgotten Fuhrman is a convicted felon. Many people admire this criminal because of his infamous crime!
Judges get in on the act too. Sometimes it’s a career killer like it was for Simpson judge, Lance Ito. Who could forget the dancing Itos from The Tonight Show?
Now we have a new player in celebrity trials, the Internet. Jurors are admonished to avoid the media, Internet or conversations connected to the cases they are asked to judge. It’s nearly impossible to police jury conduct. In low profile cases this particular kind of jury misconduct does not happen.
People selected for jury duty too often love this duty for all the wrong reasons. They lie about their prejudices and personal baggage. Like Juror Number Nine in the first Phil Spector trial admitted recently, many of them enter the jury room with their mind already made up. This kind of misconduct eliminates discussion and deliberation as a way to a verdict.
In a low profile case several years ago I wrote about a justifiable shooting case in Hollywood. I wrote about the extensive criminal record and dubious immigration status of the so-called victim. That information was kept out of the trial and not transmitted to the jury.
More than a year had passed since that shooting and I noticed my web counter got 14 Los Angeles area hits on that forgotten story. I guessed why the sudden interest. The trial of the accused began and members of the jury were all doing Google searches on the defendant’s name! They had full access to the information the court ordered withheld and my opinion on just why this was a justifiable use of force.
That trial ended and I got an e-mail and phone call from the foreman of the jury telling me they acquitted the defendant! The IP address of that jury foreman matched that of a visitor to my site numerous times throughout the trial.
The first Phil Spector trial was covered by all manner of media complete with gavel to gavel TV coverage. I had suffered an injury and my movement was very limited as a result. I used that free time to watch the coverage and fully blog the trial.
I discovered an anti-Phil Spector hate campaign develop on the Court TV website and a Sherman Oaks woman’s blog that provided a true hatemonger’s view of the Spector case.
Juror Number Nine from the first Spector trial contacted this woman blogger the very day the trial ended in a mistrial. I remain convinced that this fellow who sought conviction was reading the Sherman Oaks based hate blog every night after the trial recessed.
As for the Spector re-trial only the Sherman Oak's based hate blog is publishing information about this case on a daily basis.
Should Spector be convicted I intend to suggest to the defense lawyers that subpoenas be issued for the ISP information of the juror’s. The website address viewing of the jurors is kept by the ISP and getting that information is simple. I see a mistrial for jury misconduct and perhaps we will see jury members get some unwanted fame.
I think the only right answer in high profile cases is to sequester the jury. That will keep them away from outside influence.
A side note: As some people try to castigate Phil Spector as a hater and abuser of women, that it was Spector who made millionaires out of so many women he promoted as a record producer. Spector brought out some of the most wonderful voices we’ve ever heard.

Spector’s Lawyers Moves For A Mistrial Over Prosecutorial Misconduct
Los Angeles, CA—After prosecutor Alan Jackson’s cavalier smear of legendary record producer Phil Spector’s character in his opening Statement Doron Weinberg shot back with a formal motion for a mistrial.
Spector is on trial for murder in connection with the death of troubled and drug addicted, 40 year-old Lana Clarkson. The evidence seems to point a self-inflicted gunshot wound and that’s the defense.
Judge Larry Paul Fiddler has allowed Jackson to bring in any woman Spector ever employed or bedded in his 68 years to complain about what they now claim happened decades ago.
For the most part these women have been thieves, whores or gold diggers. They all seem to have become angry when Spector would not marry them or make them wealthy. None of them were ever injured or killed. Judge Fidler had the discretion not to allow any of them to testify but he did anyway.
One of the bimbos was Diane Ogden who since died in a drug overdose in Utah. Judge Fidler has allowed Ogden to testify from the grave via video tape. The jury however will not get to hear about her drug use and exactly what led to Ogden’s death.
Jackson has a huge problem, no reliable evidence so he is desparate to destroy Spector’s character in order to make the jury hate the hapless defendant. A jury that hates a defendant will convict in the absence of evidence and Jackson only knows that too well. Jackson overstepped the rules and as always you can expect Judge Fiddler who wants Spector convicted at any cost to let it slide.

One of the bimbos was Diane Ogden who since died in a drug overdose in Utah. Judge Fidler has allowed Ogden to testify from the grave via video tape. The jury however will not get to hear about her drug use and exactly what led to Ogden’s death.
Jackson has a huge problem, no reliable evidence so he is desparate to destroy Spector’s character in order to make the jury hate the hapless defendant. A jury that hates a defendant will convict in the absence of evidence and Jackson only knows that too well. Jackson overstepped the rules and as always you can expect Judge Fiddler who wants Spector convicted at any cost to let it slide.
