Freedom For O.J. Simpson?

Las Vegas, NV-- Okay, you forgot about the Juice didn’t you? You thought you’d heard the last when Judge Jackie Glass slammed a cell door closed on him for some nine to 33 years, didn’t you.

Well the there were some serious appeal issues surrounding that case where Simpson and some others went to get stolen property back. The problem was they called it armed robbery and kidnapping. But was it really?

Thugs, thieves and liars mistreating other thugs, thieves and liars just did not seem so serious. Judge Glass and a jury may well have gotten it all wrong. That’s why our judicial system allows for appeals.

Simpson had asked to remain free pending that appeal expected to take years and Judge Glass said, no.

On August 3, 2009 the Nevada Supreme Court is hearing arguments on the appeal of the order to deny bail.

Simpson’s co-defendant, Clarence "C.J." Stewart, is serving 7 1/2 to 27 years and has been granted a bail hearing too.

I can’t give an educated guess as to the outcome but usually they entertain the idea of bail at all may prove promising.

The same can be said about the convictions in light of Nevada case law. Simpson and Stewart may find freedom if the same court feels the convictions and punishment too extreme.

Yes folks, O.J. Simpson may be back soon. Just when you thought it was safe…

Nevada Reverses Kidnapping Case And It Will Help O.J. Simpson

Las Vegas, NV—This Sunday morning O.J. Simpson faces what may be the rest of his life in a Nevada prison. Odds are that without divine intervention the 61 year-old may not live long enough to make parole. He must serve at least nine years and parole is far from guaranteed after serving that minimum portion of the 9 to 33 year sentence.

There is however a somewhat recent case that reversed a kidnapping conviction on a much more egregious case. This suggests that Simpson was over-charged and over-convicted for what should have been a simple armed robbery.

An appeal citing this November 2006 case, may well get Simpson a second chance at a much lighter sentence. Appeals move very slowly and Simpson will be sitting in prison for as long as a couple of years before the Nevada Supreme Court hears and decides his case. In case you were wondering Nevada has no Court of Appeals so his case goes directly to the Nevada Supreme Court.

Simpson’s co-defendant, Stewart will get the same benefit from the ruling. Rather then win new trials these convicts will be re-sentenced on the lesser charge.

O.J. Simpson’s Life is Over


Las Vegas, NV—Defendants O.J. Simpson and C.J. Stewart were convicted on every count. I was not surprised that this dubious case against the football great went this far.

Simpson was convicted not for what happened in Las Vegas but a yet to be solved double murder in the Brentwood section of Los Angeles long ago.

I don’t like the arrest, trial or the verdicts. This was a subjective judgment made in an imperfect world by a jury that did not want to even stop this railroad job for meals.

Both Sides Have Rested In O.J. Simpson’s Trial

Las Vegas, NV—You can never guess what a jury will do. Jury’s logic is nearly always beyond predictions.

That Las Vegas Armed Robbery/Kidnapping case against footbal great, O.J. Simpson that should never have been filed in the first place will enter the phase of Jury Instructions and Closing Arguments. There may be a verdict as early as Friday.

The jury will be charged with sorting out the stories given by a wide assortment of thugs, thieves, liars and even a pimp, most have which have been given get out of jail free cards by prosecutors.

Watching televised trials cheats viewers of one very important insight to help predict the outcome. The faces, interaction and reaction to the accused and various witnesses with jury members provide loads of tell tale information.

Televised trials never show jury members unless they agree to give interviews when the trials are over and the verdicts have been returned.

Even with the ability to observe the jury, their verdicts often still defy predictability. One statistic remains constant, over 80% of Americans who are forced to stand trial get convicted.

O.J. Simpson’s odds are not good despite ample reasonable doubt. The best I’d hope for is a hung jury and mistrial. I’m sure O.J. Simpson would agree with my assessment that being a criminal defendant sucks.

Games Some Prosecutors Play

Las Vegas, NV—Some star struck prosecutors and cops want to take credit for putting O.J. Simpson behind bars. Instead of justice it’s about status and bragging rights. They want to brag that they could do what Los Angeles authorities couldn’t do, and that's convicting the former sports hero.

I say former sports hero because Simpson no longer has that special admiration. Today the public treats him with suspicion at best and many believe he somehow got away with double murder. Today and for always, Simpson is a kind of a dark celebrity, more famous for his perceived connection to a despicable and brutal crime than his outstanding achievements on the gridiron.

Now Simpson is on trial as a jury has to figure out just which group of thugs, thieves and liars robbed the other of Simpson’s personal memorabilia. The stories have changed despite sporadic surreptitious recordings by ringleader and convicted arsonist, Thomas Riccio. Riccio has profited by more than $200 K for arranging the entire event police and prosecutors are calling an armed robbery/kidnapping.

Prosecutors have used those tricks and tools defense attorneys will never have. One is the ability to buy whatever testimony they want through immunity and get out of jail free cards given to confessed criminals. The other is a trashy stunt they pulled with their own prosecution witness, Alfred Beardsley.

When prosecutors called sports memorabilia dealer, Beardsley as their witness he was in custody for a parole violation in California. They cleaned up Beardsley, dressed him in a suit for court and delivered him to the jury looking like any ordinary businessman. But when Simpson’s lawyer’s called for Beardsley as a defense witness a few days later he was brought into court wearing jail garb and chains. This was a cheap shot to say the least.

Simpson must sit as an all White jury passes judgment on him on this case that was only filed because he was O.J. Simpson. Simpson faces life in prison should he be convicted in a case where nobody was injured and the property taken was in fact Simpsons'. Will O.J. Simpson get a fair verdict in Sin City? The odds are against that happening.

Is Judge Hearing The O.J. Simpson Case Bi-Polar?

Las Vegas, NV—Judge Jackie Glass must have come right out of Central Casting to hear the O.J. Simpson case. Glass is an excitable, drama queen who loves to yell at lawyers like an angry mother dealing with really bad children.

It’s hard to tell if she is simply playing to the cameras or she’s this way all the time. In a single day, Glass has proven herself to be better suited for a low-budget Hollywood film rather than a real trial.

Yesterday state’s witness and sports memorabilia dealer Bruce Fromong was wincing in pain and grabbing his chest during his testimony. I was suffering a similar reaction to Judge Glass’ emotional tantrums in her zealous efforts to keep order in the court.

I can’t help but see a prejudicial effect that would defeat a fair trial for any defendant in Judge Glass’ courtroom.

Judges automatically gain huge respect from jurors who are emotionally programmed by society to except and believe judges are infallible leaders who must be obeyed.

Judges’ powers extend far beyond the simple ruling on legal issues before them. They also have the ability to convey a certain verdict to impressionable jurors.

The Simpson trial already seems headed for trouble like most high profile criminal court cases in this country.

Update: As the prosecution's case is winding down I have noticed that Judge Glass has been very fair to both sides. That makes her histronic much more bearable for me. I guess we are not all the same on this earth.

Which group of Thugs, Thieves and Liars robbed The Other?

Las Vegas, NV—The Circus starts this morning in Las Vegas. It will be the greatest show on earth watched by millions. Where you ask? Why it inside the Clark County Court! It’s the O.J. Simpson trial. Opening statements are set to begin barring last minute diversions.

The street outside will be filled with genuine clowns and publicity hounds. Reporters from everywhere will have crews loitering until the court takes their recesses and they swing into action. Live coverage of the trial is promised by a new start up TV business called The Legal Edge who promised to broadcast to any media outlets willing to pay their fees.

This is the chance for an all White jury to return a new verdict on the double-murder trial in which Simpson was acquitted. Nobody cares about the sports memorabilia thieves who claim to be robbery and kidnapping victims. This trial will really be about the killings of Nicole Brown Simpson and Ronald Goldman.

Prosecutors can be counted upon to beat the Goldman civil verdict and judgment to death showing how Simpson evaded any punishment at all for his “guilt” in the double murder. This will be anything but a fair trial.

The odds of gaining a conviction in any criminal trial are 80%. Color O.J. Simpson convicted and gone to prison for life. Nobody can overcome this kind of prejudicial prosecution.

This will prove to be a farce and a circus that shows the frailty of humans and their emotions over the American system of justice and simple fairness.

Why I Never Mourned The Demise of Court TV

Court TV showed promise to open the veils of seeming secrecy of America’s courtrooms. Trials are public but seating is limited and the logistics of sitting in courtrooms is difficult or impossible for working Americans.

Court TV was there to save the day, at least in the several states that allow for broadcasting of their proceedings. Most states and the federal courts have declined the idea of TV coverage.

Court TV began with the gavel to gavel concept but that was not working because viewers became bored with most testimony. Court TV countered by turning the proceedings into pundit fueled gossip-fests. The liberal use of outspoken harpies to slant the video they did elect to show the public got out-of-control. Trials became sporting events even beyond Jerry Springer proportions.

No better example of televised legal horror existed than the Scott Peterson Murder Trial. I’m convinced he was convicted not by a fair trial but by Court TV, aided by a very TV camera- happy defense lawyer, Mark Geragos.

Peterson was convicted and sentenced to death without any proof whatsoever of the cause of Laci Peterson and her unborn child’s death. The Court TV harpies poisoned any chance of Peterson getting a fair trial.

Did Scott Peterson kill his wife? If we can’t say how Laci Peterson died, how can we possibly call it murder? It could have been murder. Scott Peterson was proven to be a cad, cheat, liar and heel, but not a murderer.

Now we have a new Internet broadcaster, he's former lawyer, Michael Bryant with his Legal Edge team who wants to broadcast the trials and give the gossip mongers a forum to exchange misinformation and worse.

I don’t have enough information about Legal Edge’s plans other than their announcement of covering the O.J. Simpson Robbery/Kidnapping trial in Las Vegas. Perhaps Bryant can arrange to broadcast the trial to the Casino sports-books where people can place bets of court rulings and then the final verdict?

Can’t we just get some dignified gavel to gavel coverage without creating new celebrity personalities along the way? Can we just see trials rather than getting an unwanted trip to the circus?

O.J Simpson’s Gift Keeps On Giving

The larger than life O.J. Simpson was made for all manner of journalists. Sex, murder, rumors, lawyers, profiteers and Fred Goldman follow Simpson wherever he goes.

We can only speculate who murdered Nicolle Brown Simpson and Ronald Goldman. The public made their guess and jury verdicts notwithstanding, Simpson is standing alone as the killer.

The ongoing Las Vegas Palace Station robbery case is nothing but garbage. This sordid mess is not worthy of the tax dollars it will burn trying to sort out which group of thieves, thugs and liars robbed the other. Another fortune will be made by writers and pundits who cover the saga.

Simpson has made many careers and millions of dollars for so many writers and television personalities already. They include disgraced, former LAPD Detective and convicted felon, Mark Fuhrman.

Now comes yet another profiteer who is putting a new book up for sale, "How I Helped O.J. Get Away With Murder: The Shocking Inside Story of Violence, Loyalty, Regret and Remorse".

Had not the Statute of Limitations expired on felony Obstruction of Justice crimes the confession by the book’s author would bring him some well deserved prison time.

Who better to tell us about that book but the incomparable Associated Press correspondent, Linda Deutsch. Deutsch has been covering Simpson for the AP for a substantial period of her career.

You Ring, We Rat Bail Bonds

Miguel Pereira, the owner of You Ring We Spring bail bonds arranged to get O.J. Simpson released for bragging rights and to see himself on TV. Pereira also waived Simpson’s premium payment of $18,000.00. When Pereira’s publicity ran out he saw the opportunity to personally take Simpson into custody and grace TV sets worldwide with his own image.

Pereira saved Simpson’s November rambling recorded telephone message for a second wave of publicity where he could be the star. Plain and simple, Miguel Pereira is a big fat rat who sought fame at Simpson’s expense.

Did Simpson’s phone call really amount to an attempt to influence or intimidate a witness? The answer is clearly, no. Had that been the case prosecutors would have convened a grand Jury and Indicted Simpson on new charges before sundown.

Bail is our Sixth Amendment Constitutional right should we ever be accused of a crime. The purpose of bail is to insure the appearance of the suspect in court. Courts have later ruled that in addition, protection of the public is an additional consideration.

Simpson is in no way a special flight risk and has always appeared in court when required. Simpson has a right to a fair trial and now the alleged victim of the crime Simpson is accused of wants the charges dropped. Has the O.J. Simpson Circus wasted enough time of our government officials?

Update: According to a published report from correspondent extraordinaire, LINDA DEUTSCH of the associated Press, our “hero”, Miguel Pereira took a queue from Simpson’s co-defendant. It seems Pereira concealed a digital recording device on his person in an effort to record some juicy statements from the Juice during travel back to the Clark county Jail. I can only conclude that the recordings were for later sale.

I seriously doubt that lawyers, investigators or their clients would ever knowingly patronize this bonding company or Mr. Pereira’s services for any reason. Nobody likes a rat.

O.J. Simpson’s Preliminary Hearing In A Las Vegas Criminal Court

Tomorrow Simpson and his lawyer will be in court as the prosecution lays out much of their case for Armed Robbery Kidnapping and the rest of the charges related to that little get together at the Palace Station Hotel and Casino.

The prosecution’s burden is an easy one. They will put on just enough evidence to get this mess bound over for trial. There may be some limited cross-examination of suspects turned snitches and the victims. Hearsay evidence is admissible in this legal arena.

It’s a given that there will be a finding that there is Probable Cause to allow this case to go forward to a full-blown criminal trial that won’t happen anytime soon.

I just don’t expect this thug against thug mess to amount to much. The dark side of this case is that Simpson may get convicted not because of any other reason that people think he got away with a double murder over a decade in the past.

The truth here is that if the Juice was not involved this trashy case would have been dumped out with the garbage rather than clog an over-burdened court system.

Here We Go Again, O.J. Simpson Arrested!

Okay, I told you so! That O.J. Simpson’s would hear his own words said to police and press out of presence of a lawyer read back to him in a desert courtroom. Las Vegas Metropolitan police have arrested Simpson for armed robbery. The Simpson arrest followed the arrest of the babbling, co-conspirator, Walter Alexander. Unlike his last scrape, Simpson will be out on bail in short order. Bail will be very steep and any money or property posted may well be seized to satisfy Simpson's civil judgment. This case is far from a slam-dunk and may take more than a year or even two to play out. I would not be surprised to see the entire Simpson posse including involved off-duty cops behind bars very soon.

Arrest Made In Armed Robbery Stew Connected To O.J. Simpson

An unidentified man was arrested by La Vegas Metropolitan police in connection with the private “sting” engineered by Simpson. Was this a case of O.J Simpson taking the law into his own hands in the form of an armed robbery? The law always allows a private person to make an arrest but that did not happen. There are way too many questions and conflicting statements concerning whether the property was turned over voluntarily or as a result of the threat of force.

Of course in the end you need a victim willing to testify to facts that established a crime. That too is in serious doubt according to a news story containing an interview by Associated Press reporters. Now that alleged victim, Alfred Beardsley is singing yet another tune claiming what he told the AP reporters was, “off the record”

Add to the mess the participation of any off duty police officers, who Simpson may have relied on to lawfully regain his property. The problem here may not be O.J. Simpson’s but that of the officers that apparently never executed any official reports. Of course if off duty officers were involved and determined that no crime or intent to possess stolen property was involved no reports are required. The peaceful transfer of property to a rightful owner is no crime.

As for any victims and witnesses, their First Amendment rights allow them to sell their newsworthy stories right now for big bucks to TMZ.com and those South Florida supermarket rags.

Complicated? That’s an understatement. Any prosecution may well depend on the stories given by various participants. If there ever is a prosecution here I would not be surprised to see immunity granted to Simpson in exchange for his testimony against his own posse.
